So he didn't do a field sobrity test, or a breath test, didn't sign a dui citation.
How do they know he was drunk, is it by default in american law?

I don't doubt he was drunk, but still shouldn't they know for sure?
If he made it a court case, can he win it?

Either goes to trial or he had to take a test once he got to the Jail.

I think denying an on scene test is only a way to delay being tested and make the officer decide whether they want to proceed with prosecution.

I haven't been thru that process but I know some who have and that is what I have gathered.

You can refuse everything unless there is a court order. Depending on state you will auto lose your license for a year.
Most lawyers I know always say don't submit, don't admit. A good lawyer can work magic. But it won't be cheap.

The article says they took him to the jail to take a breathe test which he refused.

They also claim he appeared to have "red, glassy eyes" and his speech sounded slow, to which he replied the officer's "speech was fast."
