To prosecute the losers of the war to deter others from doing the same thing. We went into a sovereign Panama and arrested their president because we could. No one is going to send a army to the US to arrest Bush or Obama because they cant. No sitting President is going to arrest or hand over a former President because of the precidence it sets.

Maybe one day when the NWO takes over and we have the one world government @Conspiratard Numero Uno so desperately craves they will prosecute former leaders but until then this is the best we have.
