There is certainly an argument that he shouldn't have had his gun out. The suspect wasn't a deadly threat. Also, the cop could've put his gun back in the holster.

Either way, a lack of confidence in his hand to hand ability and not being issued property spray are not good or legal justifications for shooting someone.
The fuck he shouldn't have, I responded to a stolen taxi by a guy that just got released from a mental hospital, I pull in the driveway and his dad is saying to him what the fuck do you think would happen, you stole a taxi.

Dude was like 6'5, 300 lbs and batshit. I pulled my gun immediately and started telling him to turn around as he is walking to me with clenched fists. I looked at his dad and told him either you talk him down or one of us is getting hurt, I guarantee it isn't going to be me. With the father's help I got him into to cuffs. He turned into me one point but I shoved him towards the back of the trunk and stepped back. Dad was calming the savage beast.
